<p><strong>Alexandria, VA</strong>&nbsp;— Imprisoned information activist Jeremy Hammond has been found in contempt today for refusing to answer 7 questions in front of a Federal Grand Jury in the Eastern District of Virginia (EDVA). Earlier this year Chelsea Manning was remanded into custody for failure to provide testimony before the same Grand Jury.<br><br><strong>The following is a statement from the Jeremy Hammond Support Committee regarding these developments:</strong></p>



<p>“Today, in Federal Court in the Eastern District of Virginia, Jeremy Hammond was found in contempt for refusing to answer questions posed to him by a grand jury. This grand jury is&nbsp; the same grand jury currently holding Chelsea Manning in contempt for bravely refusing to answer their questions.</p>



<p>“We do not know what questions the grand jury is investigating. Moreover, it is unclear whether or not the federal prison sentence he was serving for which he was due to be released from just two short months from now, will be suspended as the result of being found in civil contempt.&nbsp;</p>



<p>“By removing him from FCI Memphis before his time in RDAP was completed, the government has added a minimum of six months onto Jeremy&#8217;s sentence. Judge Trenga has the option of jailing him indefinitely for contempt. The decision to compel Jeremy to testify despite his outspoken, long-standing anarchist beliefs and support for myriad brave grand jury resistors, only to&nbsp;place him under contempt when he adheres to those same core beliefs should be seen as little more than cruel and punitive.</p>



<p>“Jeremy has held strong to his beliefs over the past seven years. In fact, being subjected to the horrors of the legal system over and over again has been one of the defining factors that has strengthened Jeremy&#8217;s beliefs. There is nothing a grand jury could do or say that could compel Jeremy to testify. Jeremy made it clear from the beginning of his case that he had no&nbsp; intention of cooperating with the government, and that hasn&#8217;t, and will never change. Any attempts to try to force him to testify through prolonged incarceration serves to do nothing but further punish Jeremy for his political beliefs. This highlights one of the many problems with grand juries, and one of the many reasons why they should not exist, and why it is the correct and moral stance to resist them.”</p>

<p><strong><span style="text-decoration: underline;">Recent Events</span></strong><br>In late August Jeremy Hammond was removed from the Federal Correctional Institution in Memphis, Tennessee where he was serving a 10-year prison sentence after pleading guilty to charges he hacked the private intelligence contractor Stratfor Global Intelligence. At the time of his transfer Hammond was enrolled in the Federal Bureau of Prison’s intensive Residential Drug Abuse Program (RDAP) which upon completion qualifies participating inmates for early release. Hammond’s prison release date was projected to come around mid December of 2019 but because of his removal from the RDAP program and the summons to this grand jury his time incarcerated could be extended by over two years.&nbsp; Hammond is currently confined at William G. <p><strong>Alexandria, VA — </strong>Imprisoned information activist Jeremy Hammond has been called against his will to testify before a Federal Grand Jury in the Eastern District of Virginia (EDVA). Last week Hammond was removed from the Federal Correctional Institution in Memphis, Tennessee where he was serving a 10-year prison sentence after pleading guilty to charges he hacked the private intelligence contractor Stratfor Global Intelligence. Hammond’s prison release date was projected to come around mid December of 2019 but because of his removal from the RDAP program and the summons to this grand jury his time incarcerated could be extended by over two years.&nbsp; Although Hammond is still in transit it is believed he will be detained in or near Alexandria, VA for the duration of his proceedings. <br><br><strong>The following is a statement from the Jeremy Hammond Support Committee regarding these developments</strong>:<br><br>“It’s with great sadness and anger we announce that Jeremy Hammond is being brought to the Eastern District of Virginia in an effort to compel him to testify before a grand jury. Given the secrecy of grand jury proceedings, we don&#8217;t know the nature or scope of the grand jury&#8217;s investigation. However, our assumption is that this is the same grand jury that Chelsea Manning is currently being incarcerated for refusing to testify before.</p>



<p>“Jeremy pled guilty in 2013 in the Southern District of New York to one count of violating the Computer Fraud and Abuse Act. He agreed to plead guilty pursuant to a non-cooperating plea agreement that granted him immunity from further prosecution in all 94 federal judicial districts. At the time of his guilty plea, Jeremy made a statement that made it clear that he was pleading guilty so that he could speak freely about his actions and move on with his life without putting anyone else in jeopardy:</p>


<p style="padding-left: 40px;"><span style="font-weight: 400; font-family: tiempos-text-italic;">‘Today I pleaded guilty to one count of violating the Computer Fraud and Abuse Act. This was a very difficult decision. I hope this statement will explain my reasoning. I believe in the power of the truth. In keeping with that, I do not want to hide what I did or to shy away from my actions. <p>“Jeremy pled guilty to put an end to the case against him. He pled guilty because he had no interest in cooperating with the government. He was sentenced to 10 years —the maximum allowed under his plea agreement— and has been serving his time, counting down to the day that he will finally be free. That day was supposed to come in mid-December of 2019.</p>



<p>“The government&#8217;s effort to try to compel Jeremy to testify is punitive and mean-spirited. Jeremy has spent nearly 10 years in prison because of his commitment to his firmly held beliefs. There is no way that he would ever testify before a grand jury. The government knew this when they gave him immunity in every federal jurisdiction in exchange for his guilty plea. In bringing him against his will to the Eastern District of Virginia, the government has put an end to his participation in the RDAP drug program, effectively adding a year to his sentence. (If Jeremy had been permitted to complete the 9-month program, he would have earned a 12-month sentence reduction.) When he refuses to testify, his sentence will be prolonged indefinitely when he is punished with further incarceration for contempt of a court order to testify.<br></p>

<p>“The U.S. government’s blatant abuse of the grand jury process in this case continues a clear pattern of targeting, isolating, and punishing outspoken truth-tellers and activists. We must stand up and say that enough is enough. We cannot allow the government to use fascist intimidation tactics to target, imprison, silence, and torture, those who threaten their power. We must not let the government fracture us or our support for those who need us most, no matter how they may try to pit us against one another, and we must not allow them to sow fear and distrust in our communities. We must come together as one, united in our support for truth and transparency, and for those who have paid the ultimate price to bring it to us.”<br><br></p>

<p><strong>Alexandria, VA</strong>&nbsp;— This morning, the 4th Circuit Court of Appeals affirmed the District Court’s finding of contempt and denied Chelsea Manning’s motion for release on bail.</p>



<p>Neither decision included any legal reasoning or explanation for the Court’s conclusions.</p>



<p><strong>Ms. Manning</strong> is now contemplating other post-contempt remedies including an appeal to the whole panel of Fourth Circuit judges (called an “En Banc” panel) or to the Supreme Court.</p>



<p>“While disappointing, we can still raise issues as the government continues to abuse the grand jury process. I don’t have anything to contribute to this, or any other grand jury. While I miss home, they can continue to hold me in jail, with all the harmful consequences that brings. I will not give up. Thank you all so very much for your love and solidarity through letters and contributions.”</p>

<p><strong>Moira Meltzer-Cohen</strong>, of Ms. Manning’s legal team, explained why Chelsea’s subpoena and confinement should be considered grand jury abuse:<br><br>“We are of course disappointed that the Circuit declined to follow clearly established law, or consider the ample evidence of grand jury abuse.&nbsp;<br><br>“It is improper for a prosecutor to use the grand jury to prepare for trial. As pointed out in Ms. Manning’s motions and appeals, since her testimony is not necessary to the grand jury’s investigation, the likely purpose for her subpoena is to help the prosecutor preview and undermine her potential testimony as a defense witness for a pending trial.&nbsp;<br><br>“We believed that the Appeals court would consider this, as it is strong evidence of an abuse of grand jury power that should excuse her testimony.”</p>



<p>In February, 2019, Chelsea Manning was subpoenaed to give testimony before a grand jury sitting in the Eastern District of Virginia. On March 5, she moved District Court Judge Claude Hilton to quash the subpoena on a number of legal grounds, but her motions were denied.</p>



<p>After refusing to answer questions before the grand jury, Chelsea was found in civil contempt of court and conveyed to the Alexandria Detention Center on March 8. <p>“The indictment against Julian Assange unsealed today was obtained a year to the day before Chelsea appeared before the grand jury and refused to give testimony. The fact that this indictment has existed for over a year underscores what Chelsea’s legal team and Chelsea herself have been saying since she was first issued a subpoena to appear in front of a Federal Grand Jury in the Eastern District of Virginia — that compelling Chelsea to testify would have been duplicative of evidence already in the possession of the grand jury, and was not needed in order for US Attorneys to obtain an indictment of Mr. Assange. &nbsp;Grand Juries may not be used for the sole and dominant purpose of preparing for trial, including questioning potential trial witnesses. <p><strong>Alexandria, VA </strong>— Today Chelsea Manning’s attorneys asked the Fourth Circuit Court of Appeals to vacate (void) District Court Judge Hilton&#8217;s finding of civil contempt. The following is a statement from Chelsea Resists!, Chelsea Manning’s Support Committee, regarding today’s filing: </p>



<p>“Chelsea&#8217;s legal team is asking the Fourth Circuit Court of Appeals to vacate (void) District Court Judge Hilton&#8217;s finding of civil contempt, for three main reasons:<br></p>



<p>“1) Because it would appear that Judge Hilton denied Chelsea&#8217;s motion asking the government to disclose the existence of any unlawful surveillance without actually considering the evidence. Rarely does a judge deny a motion without doing so explicitly or making any actual rulings or statements about any of the legal issues brought before the court.<br></p>



<p>“Judge Hilton didn&#8217;t question the government about any of the issues or facts raised in the electronic surveillance motion. He did not even ask the government to make simple affirmations or denials regarding whether it was aware that electronic surveillance had occurred, although the law requires that the government make such denials once a &#8220;colorable claim&#8221; is raised. <br></p>



<p>“These questions about surveillance are especially important because any evidence derived from unlawful surveillance may not be used in a grand jury, and the existence of such surveillance would excuse Chelsea from having to testify before the grand jury.<br></p>



<p>“2) Because the Judge failed to demand even minimal assurances that the subpoena was properly motivated, despite ample evidence of abuse. <br></p>



<p>“The proper purpose of the grand jury is to investigate federal crimes, and if justified, issue indictments. Prosecutors may not use the grand jury for the primary purpose of preparing for trial of an already-secured indictment. Chelsea raised concerns that the government did not need her testimony to further their investigation, and that rather they intended to use the subpoena to preview and perhaps undermine any testimony she might give at trial for an already-pending indictment. This would be an abuse of process which would excuse her testimony. If the purpose of the subpoena was improper, it should have never been issued in the first place.<br></p>



<p>“The District Court Judge should have considered these arguments, and elicited confirmation of proper purpose from the government. He did not consider the facts or the law on this motion, and the finding of contempt should therefore be reversed.<br></p>



<p>“3) Because significant portions of the contempt hearing were held in a closed courtroom in violation of Chelsea&#8217;s 5th and 6th Amendment rights to a public trial, and the Government has not given any good reasons for keeping the proceedings secret.<br></p>



<p>“Remember that even though Chelsea has not been convicted or even accused of a crime, she is still being held in conditions that amount to solitary confinement. We hope at the very least that the Fourth Circuit will release her during the appeal process, on the basis that her so-called civil confinement has been transformed into punishment, which is not legally permissible.</p>



<p>“It is important to remember that Chelsea is currently being subjected to a form of imprisonment that arises to the level that the UN and many other <a href="https://xychelsea.is/?page_id=28">experts consider to be torturous</a> which is especially egregious given that Chelsea has not been charged with or convicted of a crime.”</p>

<p>“Chelsea can’t be out of her cell while any other prisoners are out, so she cannot talk to other people, or visit the law library, and has no access to books or reading material. She has not been outside for 16 days. She is permitted to make phone calls and move about outside her cell between 1 and 3 a.m.. &nbsp;<br></p>



<p>“As today is Day 16, Chelsea is now in “Prolonged Solitary,” as defined by Juan Mendez, UN Special Rapporteur on Torture:[3] &nbsp;&nbsp;&nbsp;<br></p>



<p>“I have defined prolonged solitary confinement as any period in excess of 15 days. This definition reflects the fact that most of the scientific literature shows that, after 15 days, certain changes in brain functions occur and the harmful psychological effects of isolation can become irreversible. Prolonged solitary confinement must be absolutely prohibited, because it always amounts to cruel, inhuman or degrading treatment, and may even constitute torture…” <br></p>



<p>“The jail says keeping ‘high-profile’ prisoners in adseg is policy for the protection of all prisoners, but there is no reason to believe jail officials view Chelsea as either a target or a risk. If Truesdale wants to prioritize Chelsea’s health and welfare, as they consistently claim, then they should make sure she is able to have contact with other people in the jail. <br></p>



<p>“We have worked to monitor Chelsea’s well-being since her arrival at Truesdale. In her first week she contracted a bacterial infection which has since been resolved by antibiotics. More recently, she experienced the shift between the prolonged under stimulation of 22-hour lock-down and a 45-minute social visit as so jarring that she threw up. <br></p>



<p>“Although the facility has accommodated Chelsea’s medical needs, including hormone medications and daily post-surgery treatment, keeping her under these conditions for over 15 days amounts to torture, possibly in an attempt to coerce her into compliance with the Grand Jury. The Mendez Report notes this tactic: ‘I have observed that solitary confinement … is often used as a deliberate method to obtain information or confessions. In such conditions, confinement amounts to a coercive tool and constitutes a cruel, inhuman or degrading treatment, and possibly torture.’[4] &nbsp;&nbsp;&nbsp;<br></p>



<p>“Chelsea is a principled person, and she has made clear that while this kind of treatment will harm her, and will almost certainly leave lasting scars, it will never make her change her mind about cooperating with the grand jury. <br></p>



<p>“It bears repeating that while solitary confinement should not be used for anyone, it is especially immoral to place Chelsea in solitary, when she has not been accused of, charged with, nor convicted of any new crime. <br></p>



<p>“We call upon the William G. Truesdale Adult Detention Center to remove Chelsea from “Administrative Segregation” and these conditions which effectively constitute solitary confinement immediately.”</p>

<p><strong>Alexandria, VA </strong>— On Wednesday March 6, 2019 Chelsea Manning appeared before a Federal Grand Jury in the Eastern District of Virginia (EDVA) and refused to answer questions from prosecutors regarding the release of information she disclosed to the public in 2010. &nbsp;Chelsea invoked her 1st, 4th, and 6th Amendment protections to provide just cause for her refusal. &nbsp;On Friday March 8, 2019 Chelsea will return to the court for a hearing wherein Judge Hilton will consider the legal grounds for her refusal. &nbsp;The following is a statement from Chelsea Manning regarding the Grand Jury and the possible consequences associated with her refusal: </p>



<p>“On Friday, I will return to federal court in Alexandria, Virginia for a closed contempt hearing. A judge will consider the legal grounds for my refusal to answer questions in front of a grand jury. The court may find me in contempt, and order me to jail. <br></p>



<p>“Yesterday, I appeared before a secret grand jury after being given immunity for my testimony. All of the substantive questions pertained to my disclosures of information to the public in 2010—answers I provided in extensive testimony, during my court-martial in 2013. I responded to each question with the following statement: ‘I object to the question and refuse to answer on the grounds that the question is in violation of my First, Fourth, and Sixth Amendment, and other statutory rights.’<br></p>



<p>“In solidarity with many activists facing the odds, I will stand by my principles. I will exhaust every legal remedy available. My legal team continues to challenge the secrecy of these proceedings, and I am prepared to face the consequences of my refusal.”</p>

<p>“By serving Chelsea Manning with a grand jury subpoena, the government is attempting once again to punish an outspoken whistleblower for her historic disclosures. We stand with Chelsea in support of her refusal to participate in this repressive and undemocratic process.</p>
<p dir="ltr">“Grand juries are notoriously mired in secrecy, and have historically been used to silence and retaliate against political activists. Their indiscriminate nature means the government can attempt to artificially coerce a witness into perjury or contempt. Chelsea gave voluminous testimony during her court martial. She has stood by the truth of her prior statements, and there is no legitimate purpose to having her rehash them before a hostile grand jury.</p>
<p dir="ltr">“Since her release in 2017, Chelsea has become a prominent public speaker, emboldening countless activists who resist fascism, white supremacy, and transphobic bigotry. Her 2010 disclosures exposed war crimes in Iraq and Afghanistan, and showed the public the true nature of 21st century asymmetric warfare. By employing these tactics against her, the government is using a roundabout method to further punish Chelsea for her past actions, adding to the seven years of trauma, imprisonment and torture she has already endured.</p>
<p dir="ltr">“Since its first day in office, the current administration has attempted to erase every last piece of Barack Obama&#8217;s legacy — from the Affordable Care Act to civil rights protections for transgender people. An outpouring of support by journalists, activists and other whistleblowers in the run-up to the sentencing hearing has focused on Jeremy Hammond&#8217;s actions as civil disobedience, motivated by a desire to protest and expose the secret activities of private intelligence corporations.</p>

<p class="hang-2-column">Many of the supporters plan to be present at Mr. Hammond’s sentencing to voice their concern and to raise public awareness of the disproportionate sentences associated with the Computer Fraud and Abuse Act (CFAA), which grants greater protection to corporations than those it affords to individuals. Private companies like Stratfor account for 70 percent of the government intelligence budget and often operate without public scrutiny or government oversight.</p>

<p class="hang-2-column">The information released by Mr. Hammond for the first time gives the American people and others in the world a picture of the role that private intelligence corporations play in surveillance of legally and constitutionally protected activities and the activists involved. The Stratfor documents have given us the understanding that private intelligence companies may be a bigger problem for civil liberties than our own government and it is these companies that we ought to be suing as we pursue government accountability for surveillance,” said Michael Ratner, President Emeritus at The Center for Constitutional Rights.</p>
<p class="hang-2-column">In a letter of support for Mr. Hammond, Pentagon Papers whistleblower Daniel Ellsberg wrote: “My decision to go public with the Pentagon Papers was a difficult one. At my own risk, I released them, just as Jeremy Hammond has done. I believe the actions taken by Jeremy Hammond need to be viewed in a context that considers the profound consequences of private surveillance of political activists in the United States.”</p>
<p class="hang-2-column">“[Jeremy Hammond] performed an act of civil disobedience out of a deeply held belief that the people have a right to know what the government and unregulated corporations are doing behind closed doors against them,” wrote Jesselyn Radack, a whistleblower and former ethics adviser to the Department of Justice, in a letter of support for Jeremy. “He is a patriot who only sought to provide transparency and expose the surveillance crimes being perpetrated on the American people.”</p>
<p class="hang-2-column">A longtime social activist and proponent of ethical hacking, Jeremy has stated that he revealed the information about Stratfor because &#8220;people have a right to know what governments and corporations are doing behind closed doors.&#8221;</p>

<p class="hang-2-column">Originally facing a sentence totaling more than 35 years and additional indictments in 12 other federal jurisdictions, Jeremy pled to a single count of conspiracy under the draconian Computer Fraud and Abuse Act (CFAA). He faces a maximum of ten years. Jeremy&#8217;s co-defendants from England and Ireland have received sentences ranging from probation to 30 months in prison and are not likely to be extradited to the US.</p>
